Terms of service

These terms are an agreement between you and McIntosh.Farm LLC, a Missouri limited liability company (“we”, “us”), for the TractorTrack web app, iPhone app and this website (together, “the service”). By creating an account or using the service, you agree to them. If you use it for a farm or business, you agree on its behalf and confirm you’re allowed to.

These terms include our privacy policy and our fair use and acceptable use policy.

1. Your account

  • You need to be at least 18, or have a parent or guardian agree to these terms for you.
  • Sign in with your own Google or Apple account and keep it secure. You’re responsible for what happens in your account.
  • Tell us right away at [email protected] if you think someone else has accessed it.

2. Farm accounts and members

  • Records belong to a farm account. Its owner controls who’s a member and what role they have, can rename the farm account, and can ask us to close it. Admins can manage members too.
  • Everything in a farm account is visible to its members. Only invite people you trust with those records.
  • If you’re removed from a farm account, you lose access to its records. They stay with the farm.

3. Your data

  • Your records are yours. You give us permission to store, process, back up and display them only to provide the service to you and your farm.
  • You can export your records at any time, on any plan, including after a paid plan ends.
  • Make sure you have the right to anything you enter.

4. Plans, payment and cancellation

  • The Free plan has no charge. Paid plans (Farm and Operation) are billed once a year, in advance, in US dollars. Prices and limits are shown on our pricing and fair use pages.
  • Paid plans renew automatically each year unless you cancel. We’ll email you before each renewal. You can cancel any time; your plan stays active until the end of the year you paid for.
  • Refunds: if you’re not happy, ask within 30 days of a payment and we’ll refund it in full.
  • If a payment fails or a plan ends, your farm account moves to the Free plan’s limits. You keep all your records and can still view and export them; you just can’t add more beyond the limits.
  • If we change prices, we’ll tell you at least 30 days before it affects your next renewal.
  • Payments are handled by Stripe. Taxes may apply.

5. Early access

Some features are new or in testing, and may change or be removed. We’ll tell you before removing anything you rely on.

6. Maintenance information is a record, not advice

TractorTrack helps you keep track of maintenance. Due dates, intervals, suggested services and other information in the app are estimates based on what’s entered. They aren’t a replacement for the manufacturer’s manual, a qualified mechanic, or your own judgment. You’re responsible for maintaining and operating your equipment safely, and for meeting any legal or warranty requirements.

7. Acceptable use

Use the service only as allowed by our fair use and acceptable use policy. We may limit, suspend or close accounts that break it, as described there.

8. Availability and changes

We work to keep the service running and your data backed up, but we don’t promise it will always be available or error-free. We may change or improve the service over time. If we ever shut the service down, we’ll give at least 60 days’ notice so you can export your records, and refund any unused part of a paid year.

9. Ending your account

You can stop using the service and delete your account at any time. We may close accounts that break these terms (see section 7), or that have been inactive on the Free plan for more than two years, after emailing the owner at least 30 days ahead.

10. Disclaimers

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

11. Limit of liability

To the extent the law allows:

  • We aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, crops, revenue, data or equipment downtime.
  • Our total liability for any claim about the service is limited to the greater of what you paid us in the 12 months before the claim, or $50.

Some places don’t allow these limits, so they may not all apply to you.

12. Indemnity

If your use of the service, or content you enter, breaks the law or these terms and causes a claim against us, you agree to cover our reasonable costs from that claim.

13. Governing law and disputes

These terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. Before filing any claim, please email us so we can try to resolve it informally. Any dispute that isn’t resolved will be handled in the state or federal courts located in Missouri, and both of us agree to their jurisdiction. Either of us may bring an eligible claim in small claims court instead.

14. Changes to these terms

We may update these terms. We’ll change the date above and, for significant changes, email account owners at least 30 days before they take effect. If you keep using the service after that, the new terms apply.

15. Other terms

If part of these terms can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver of it. You may not transfer these terms without our consent; we may transfer them as part of a sale or reorganization of the business. These terms are the entire agreement between us about the service.
